Terms of Service

The service

Fleet spend that reconciles itself. Drivers pay with one card, photograph the receipt in the message thread they already use, and the match, the line items and the tax record are done before they are back in the cab.

These Terms are an agreement between you and Spartan Stack, the corporation that operates spartanstack.com and the Spartan Stack service. By creating an account or purchasing, you accept them.

The payment card is issued by a licensed issuing partner under a separate cardholder agreement. Spartan Stack is software. It does not issue the card, does not hold your funds, does not take deposits and is not a bank.

Accounts

You give accurate information, you keep your credentials secure, and you are responsible for activity under your account. You must be 18 or older.

Purchases and billing

Prices are shown before you pay. Spartan Stack charges the payment method you provide, on the cycle shown at checkout, until you cancel. You can cancel at any time and the cancellation takes effect at the end of the paid period.

The card, and where the money sits

The card is issued by a licensed issuing partner and is subject to that partner's cardholder agreement, which the customer accepts when the cards are issued. Funds loaded to or drawn on the card are held by that partner or its bank. Spartan Stack never holds customer funds and never takes custody of money.

Disputes, chargebacks, card replacement and any limit or block on a card are handled under the issuing partner's agreement.

Fuel tax filings remain the customer's

Spartan Stack assembles miles and gallons by state from card transactions and the vehicle data the customer connects, and produces a report the customer can file from. The customer files its own returns and remains responsible for their accuracy, for its licenses and decals, and for any assessment, interest or penalty.

Drivers and the message channel

Receipt images a driver sends through a messaging channel are processed to match a transaction and for nothing else. The messaging provider's own terms and its message and data rates apply to that channel, and the customer is responsible for telling its drivers that receipts sent there are processed by this service.

Estimates and exceptions

Savings figures, gallons against miles comparisons and exception alerts are estimates drawn from the data available. An exception alert is a prompt to look, not a finding of misuse by any driver.

Acceptable use

You will not misuse the service, attempt to access other users' data, resell access without permission, or use the service to break the law.

Intellectual property

The software, the interfaces, the written materials and the site belong to Spartan Stack or its licensors. You keep ownership of the content and data you supply.

SMS messaging, account notifications

Program description: Spartan Stack sends recurring automated account notifications text messages to the mobile number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply.

To stop receiving messages, reply STOP to any message from the number that texted you. For help, reply HELP to the number that texted you, or email support@spartanstack.com.

Carriers are not liable for delayed or undelivered messages.

Disclaimer

The service is provided as is. To the fullest extent permitted by law, Spartan Stack disclaims all warranties, express or implied, including fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Spartan Stack is not liable for indirect, incidental, special, consequential or punitive damages, and total liability is limited to the amount you paid in the twelve months before the claim.

Changes

Spartan Stack may update these Terms. Material changes are posted on this page with a new date.

Governing law

These Terms are governed by the laws of Texas, without regard to conflict of law rules.
